How Delhi govt, L-G fought it out in court

New Delhi, 3 July ( Panjabi Tmes News) Following is the chronology of events in the case related to the power tussle between the Centre and Delhi government in which a five-judge bench of the Supreme Court on Wednesday unanimously held that Lieutenant Governor Anil Baijal does not have independent decision making powers and is bound to act on the aid and advice of the Council of Ministers.

It had started with lodging of an FIR in 2014 by the then Arvind Kejriwal regime against Reliance Industries Ltd (RIL), Mukesh Ambani and others including UPA ministers M Veerappa Moily and Murli Deora (since dead), accusing them of "fixing" gas prices.

May 2, 2014: RIL moves HC for quashing of FIR and challenging a 1993 notification of the Centre giving power to Delhi government's Anti-Corruption Branch (ACB) to probe union government employees.

May 8: Centre moves HC opposing FIR against the ministers contending that ACB has no powers or jurisdiction to probe.

May 9: HC issues notice to Delhi government on the plea to quash FIR against the ministers. HC allowed ACB to continue with its probe.

May 20: HC asks Centre, RIL to cooperate with ACB probe.

Aug 9: ACB tells HC that it has powers to lodge FIR in gas pricing case.

Aug 19: ACB tells HC it cannot probe the gas pricing case against RIL and a former UPA minister as a July 23, 2014 notification of Centre has taken away its jurisdiction to investigate central government employees.

Oct 16: Delhi government tells HC its ACB can prosecute RIL and ministers.

Oct 28: HC gives time to Centre to clarify on ACB's powers.

Dec 4 : RIL argues in HC that State probing Centre's decision on gas pricing is absurd.

May 25, 2015: HC says ACB has jurisdiction to arrest policemen who come under Centre. It says the Centre's May 21 notification limiting ACB's powers was "suspect".

May 26: PIL in HC against Centre's May 21 notification giving powers to LG to appoint bureaucrats in Delhi.

May 28: Delhi government moves HC on Centre's notification on LG's powers. Centre moves SC against HC's May 25 order terming as "suspect" its notification.

May 29: HC asks LG to consider Delhi government's proposals on shifting of nine bureaucrats from one post to another.

Jun 10: HC refuses to stay MHA notification on ACB power.

Jun 27: Delhi government moves HC to restrain LG appointee ACB chief M K Meena from entering anti-graft body's office.

Jan 27, 2016: Union government tells HC that Delhi is under Centre's control and not full-fledged state.

Apr 5: AAP government asks HC to refer to larger bench petitions on powers of LG on the governance of Delhi.

Apr 6: Delhi government tells HC it was competent to set up a commission to probe allegations of corruption in awarding licence to conduct CNG fitness tests.

Apr 19: AAP government withdraws from SC its plea seeking setting up of a larger bench in HC.

May 24: HC reserves order on AAP government's plea for a stay on proceedings on the petitions arising out of its stand-off with LG over powers to appoint bureaucrats in the national capital and other issues.

May 30: HC turns down AAP government's request to first decide its stay application.

Jul 1: SC agrees to hear AAP government's plea seeking a direction that HC be restrained from delivering judgement on issues, including the scope of powers of the city government to exercise its authority in performing public functions.

Jul 4: Justice J S Khehar of SC recuses from hearing AAP govt's plea on declaration of powers of Delhi as a state.

Jul 5: Justice L Nageshwar Rao of SC also recuses from hearing Delhi government's plea.

Jul 8: SC refuses to entertain Delhi government plea to first decide the preliminary issue as to whether it has the jurisdiction over disputes between the Centre and the state or is it "exclusively" triable by the apex court.

Aug 4: HC says LG is administrative head of National Capital Territory and AAP government's contention that he is bound to act on the advice of Council of Ministers was "without substance".

Feb 15, 2017: SC refers to constitution bench the pleas on Delhi-Centre row over governance.

Nov 2: Constitution bench of SC commences hearing.

Nov 8: SC observes that responsibilities conferred upon LG are not absolute.

Nov 14: SC raises a question if constitutional scheme on division of executive powers between the Centre and the states can be made applicable to the union territory of Delhi.

Nov 21: Centre opposes AAP government's submissions in the SC, says Delhi has been accorded "special status" among union territories but that does not make it a state.

Dec 6: SC reserves judgement on a batch of pleas on Delhi-Centre power tussle after hearing arguments for 15 days.

Jul 4, 2018: SC says LG does not have independent decision making powers, and is bound to act on the aid and advice of the Council of Ministers.

HPCC President Dr. Ashok Tanwar launches Jan Sampark Abhiya at Panchkula

Panchkula, 9 October  ( Panjabi Tmes News) To further strengthen the Congress Party at the ground level, Dr. Ashok Tanwar, former M.P., President, Haryana Pradesh Congress Committee launched “Jan Sampark Abhiyan” in Sector 11 Market of Panchkula. He disclosed that campaign has started at all the district headquarters of Haryana by the local Party leaders and workers with full gusto. Prof. Dinesh Kumar, VC YMCA’s Appointment Term Extended Further for 3 years

Bose (erstwhile YMCA) University of Science and Technology, Faridabad, Mr. Satyadeo Narain Arya, on the recommendation of Chief Minister Mr. Manohar Lal, has extended the term of appointment of Prof. Dinesh Kumar, Vice Chancellor of the University with effect from November 4, 2018 for a period of three years. The notification to this effect has also been issued.

Valedictory Function on Wildlife Week Celebration 2018

A photo of a Rajasthan minister Shambhu Singh Khatesar urinating in open has gone viral on social media.Rajasthan Minister Shambhu Singh Khatesar urinates in open.The viral photo shows minister Khatesar urinating in Ajmer, next to a BJP’s poster with CM Vasundhara Raje’s picture. Prime Minister Narendra Modi was to address the rally there. But, Minister Shambhu Singh Khatesar sees nothing wrong in it and terms it an “old-age-tradition,” a report said.Khatesar has caused major embarrassment to the ruling BJP in Rajasthan. The viral photo shows him relieving himself near a poster featured Chief Minister Vasundhara Raje. He also violated Prime Minister Narendra Modi’s “Swachh Bharat Abhiyaan”.

UT Employees’ Annual Performance Process Streamlined

Chandigarh, 8 October  ( Panjabi Tmes News)   In a major transformation aimed at streamlining the process of annual performance appraisals of the Government Employees, Annual Performance Appraisal Reports (APAR) for the FY 17-18 have been completed in the online mode. The earlier system was plagued with delays often caused by the transfer of officers to their parent state or other locations. It is for the first time that the appraisals of most of the GroupA, B, and C employees have been completed in time. Of close to 13000 employees whose performance was due, 98.25% had submitted their self-assessments online. Subsequently, the APARs were written at 3 levels by the Reporting Authority, Reviewing Authority and Accepting Authority of the respective employees. Compliance in excess of 98% has been achieved at all these levels. Currently, performance rating are being disclosed to the employees.

Property Tax Notice Issued with wrong calculation.

Chandigarh, 8 October  ( Panjabi Tmes News) Many residents of Panchkula have brought to my notice that they are being served with Property Tax notice for the year 2018-2019 with wrong calculations in spite of the fact that the payments have already been deposited with the Corporation. It has resulted in to lot of harassment / resentment among the general public, which is earning bad name for the Corporation. In many cases even the area prescribed of calculation for property tax has wrongly been mentioned and many property owners who have already paid their dues are being served notices to deposit the property tax by 31-10-2018. Haryana CM Launched Vikas Geet CD Composed bt DIPR

Chandigarh, 8 October  ( Panjabi Tmes News)  Haryana Chief Minister, Mr. Manohar Lal today launched ‘Vikas Geet’ CD composed by Information, Public Relations, and Languages Department, at Gurugram. 2nd Round of Enhancement on Defaulting HSVP Allottees Soon!

Chandigarh , 8 October  ( Panjabi Tmes News)  While giving major relief to the allottees of Haryana Shahari Vikas Pradhikaran (HSVP), Haryana Chief Minister, Mr. Manohar Lal said that HSVP allottees would be given one more opportunity to deposit the enhancement dues of their plots by giving them the rebate.  Mr Manohar Lal was interacting with the media persons on the occasion of launch of Vikas Geet CD  prepared by Information, Public Relations and Languages Department in Gurugram today.   He said that the HSVP allottees himself had raised the enhancement issue and wanted to get it resolved. He said that a large number  of allottees took benefit of 40 per cent rebate given to them recently for settling their enhancement dues under which an amount of Rs 850 crore were deposited as against enhancement of about Rs 1400 crore.

Education Department has been working since 2015 to make school campuses tobacco-free. The Pledge for Life campaign intends to make youth as the leaders of an anti-tobacco movement.

Advisory Council Meet in Chandigarh

Venkaiah Naidu has said that education is an instrument of social transformation adding that it forms the foundation for empowering women, especially in a country like India.Delivering the Convocation address at the University College for Women in Hyderabad today, he said that no country can make progress if women lag behind. Educating a woman would not only empower an individual but an entire family.
